The SpeakEasy Collective (“we,” “us,” or “our”) respects your privacy and is committed to protecting it. This Privacy Policy describes how we collect, use, and safeguard your information when you use our mobile application, SPKeasy (the “App”).

1. Nature of the Service (Sub-Clinical Support)

SpeakEasy provides empathetic, non-clinical, human-to-human conversation.

  • We are not a healthcare provider

  • Listeners are not licensed professionals

  • We do not provide diagnosis, treatment, or medical advice

Not a Crisis Service

If you are in immediate danger or crisis:

  • Call 911, or

  • Call/text 988 (Suicide & Crisis Lifeline)

2. Information We Collect

We collect only the information necessary to provide and improve the Services.

2.1 Minimum Required Personal Information

To provide you with the services we offer, we may collect at a minimum the following information about you:

  • Name (first and last) — This helps us identify and properly address you

  • Work or other Email Address — By default, emails serve as the primary method of contact

  • Employer Name — Required for Sponsored plans and generally provided by the Employer

  • Post-Call Sentiment — An optional survey to let us know how we are doing

  • Phone number — An optional contact method used for additional security verifications

2.2 Payment Information

Payment data is only collected from employers and self-sponsoring users, and processed via PCI-DSS Compliant Platforms or service providers (e.g., Stripe, Square, Intuit, etc.).

The payment information we collect includes:

  • Name on Card

  • Card Number

  • Billing Address

Please note that, we do NOT store full card details. Upon purchase, your payment information is tokenized and made identifiable under a unique set of characters, with only the last 4 digits accessible by us for easy retrieval and reference.

Voluntary Personal and Health Information

SPKeasy is an app dedicated to physical, emotional, and mental wellness. To support our users in their everyday life, hurdles, and happy moments, our team provides one-on-one listening sessions designed to discuss a wide variety of topics in the following areas:

  • Career

  • Family

  • Personal Interests

By voluntarily attending a session and connecting with our Listeners, you agree to share only the information you deem necessary and relevant to your topic of discussion.

2.3 Voice Communication Data

Audio recordings and transcripts of voice conversations (see Section 4).

2.4 App Usage & Metadata

As a Master Service Provider to our Clients, we are expected to track and maintain a minimum amount of usage information to better evaluate the quality and usefulness of the services we provide. To comply with these requirements, we may collect and store the following information:

  • Session duration frequency

  • Feature usage

  • App activity (clicks, navigation, timestamps)

  • Features requests

  • Other similar set of information

2.5 Device & Technical Data

To maintain the Confidentiality, Integrity, and Accessibility (CIA) of the data you share with us, we may periodically monitor and track the following device and other technical data:

  • Device type

  • Operating system

  • IP address

  • Network information

  • App performance data

    3. The "Employer Wall" (Anonymity Commitment)

We do NOT share:

  • Your name

  • Your email

  • Your individual session history

  • Any available transcripts

With your employer

We DO share:

  • Aggregated, anonymized reporting only
    (e.g., “Total sessions used this month”)

Additional Protections

  • Phone numbers are masked using proxy technology

  • Listeners cannot see your personal contact information

4. Transcription and Data Handling

Conversations via the Parlour are monitored to ensure the safety of all SPKeasy users and the quality of the services we provide. Additionally, calls are transcribed for quality and compliance purposes.

4.1 Consent

By using the Parlour, you understand that your speech will be transcribed for quality assurance and training purposes. All transcripts are stored securely and are to be used only for the purpose as described in this agreement.

You can opt out of call transcriptions at every call by unchecking the statement box.

4.2 Processing

Transcriptions and call monitoring activities are performed by a combination of humans, systems, and bots. For increased accuracy of transcriptions, calls are recorded and kept for a maximum of … days to allow for full transcriptions. Upon the transcript validation, a digital copy is made available to you in the app, and the recording is permanently deleted.

4.3 Storage & Security

We rely on cloud and connected systems to perform all operations described herein.

While we use up-to-date physical and cybersecurity tools and practices, including but not limited to AES-256 encryption, least-privilege principles, and a Zero-trust architecture, please keep in mind that any information shared over the Internet Protocol is subject to loss, misuse, or alteration. Therefore, we cannot warrant the security of your information when in transit.

4.4 Retention

Transcripts are retained for up to 12 months. Past this period, transcripts are permanently deleted, unless:

  • Required for legal compliance

  • Flagged under safety protocol

4.5 Use of Transcripts and Aggregated Insights

Transcripts are used primarily to support service quality, safety, and product improvement.

Unless otherwise required for safety, legal compliance, or explicitly authorized by the user:

  • Transcripts are not individually analyzed, profiled, or used to make decisions about specific users

  • Transcript data may be used in an aggregated and anonymized form to:

    • Measure service effectiveness

    • Improve listener training and experience quality

    • Identify general usage patterns and trends

All transcript data is stored securely in an encrypted cloud infrastructure and is accessible only to:

  • The user associated with the session, and

  • Authorized personnel of The SpeakEasy Collective on a limited, need-to-know basis

We do not use transcripts for advertising, selling data, or building individual user profiles.

4.6 Optional Transcript Collection

We may offer users the ability to opt out of transcript storage for their sessions.

If transcript storage is disabled:

  • Conversations may still be processed in real time to facilitate the session

  • No transcript will be retained after the session ends, except where required for:

    • Safety protocols

    • Legal obligations

Disabling transcript storage may limit our ability to:

  • Provide certain support features

  • Investigate safety concerns or disputes

Users will be informed of these limitations at the time of opting out.

5. How We Use Your Information

We use your information to:

  • Provide and operate the Services

  • Facilitate conversations and connections

  • Maintain safety and enforce policies

  • Conduct quality assurance and service improvements

  • Process payments (if applicable)

  • Provide customer support

  • Detect fraud, misuse, or technical issues

  • Comply with legal obligations

6. How We Share Information

We do not sell your personal data.

We may share information only in the following cases:

6.1 Service Providers

We use trusted third parties to operate the Services, including:

  • Google Cloud/infrastructure providers (data storage and processing)

  • Twilio (voice communication infrastructure)

  • Payment processors (e.g., Stripe)

These providers are contractually obligated to protect your data and may only use it to provide services on our behalf.

6.2 Safety & Legal Obligations

We may disclose information when necessary to:

  • Comply with applicable law, subpoena, or court order

  • Protect users or others from harm

  • Respond to credible threats

6.3 Duty to Act

We may share limited information with emergency services if:

  • There is a clear, specific, and imminent risk of harm

6.4 Data Requests & Protection of Minors

We may disclose or process information as necessary to:

  • Respond to valid data access or deletion requests submitted by users

  • Comply with applicable privacy laws, including obligations related to children’s data

  • Investigate and, if necessary, remove accounts that violate our policies, including accounts suspected to belong to individuals under the age of 13

If we become aware that personal information has been collected from a child under 13 without appropriate consent, we will take steps to delete such information.

7. Device Permissions

The App may request access to:

Microphone

  • Required for voice sessions

  • Only active during use

Audio Settings

  • To optimize call quality

WebView Audio

  • For in-app browser voice features

You may disable permissions in your device settings, but functionality may be limited.

8. Data Security

We implement administrative, technical, and organizational safeguards to protect your data.

Security Measures Include:

  • Encryption (in transit and at rest)

  • Two-Factor Authentication (2FA)

  • Access controls and monitoring

No system is 100% secure. You are responsible for safeguarding your credentials.

9. Your Privacy Rights

Depending on your location (including California), you may have the right to:

  • Access your personal data

  • Request correction

  • Request deletion

  • Restrict or object to certain processing

Deletion Policy

All requests for data deletion and account closure should be submitted via our Contact page.

  • Account deletion requests are processed within 30 days

  • Identifiable data and transcripts are removed from active systems

10. Children’s Privacy

The Services are intended for individuals 18 years of age or older.

We do not knowingly collect, use, or disclose personal information from children under the age of 13 in accordance with the Children’s Online Privacy Protection Act (COPPA).

If you are under 13, please do not use the Services or provide any personal information.

If we become aware that we have inadvertently collected personal information from a child under 13, we will promptly delete such information.

11. Changes to This Policy

We may update this Privacy Policy from time to time.

Updates will be posted within the App or website with a revised “Last Updated” date.
