1. Acceptance of the Terms of Use
These Terms of Use (“Terms”) are a legal agreement between you (“User,” “you”) and The SpeakEasy Collective LLC (“The SpeakEasy,” “Company,” “we,” or “us”).
These Terms govern your access to and use of:
Our mobile application
Website
Voice-based conversation services
Related software, features, and support services
(collectively, the “Services”)
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
Eligibility
You must be at least 18 years old to use the Services.
By using the Services, you represent that you meet this requirement.
2. Nature of the Service (Non-Clinical Disclaimer)
The SpeakEasy provides a platform for empathetic, human-to-human conversation and active listening.
2.1 Non-Clinical Service
Listeners are not licensed therapists, doctors, or mental health professionals
The Services are not intended to diagnose, treat, or cure any condition
2.2 Not a Crisis or Emergency Service
The Services are not appropriate for emergencies.
If you are experiencing:
A medical emergency
Thoughts of self-harm
Risk of harm to others
You must immediately contact:
911, or
988 (Suicide & Crisis Lifeline), or
Your local emergency services
3. Accounts, Access, and Security
3.1 Account Responsibility
You are responsible for:
All activity under your account
Maintaining the confidentiality of your login credentials
You may not:
Share your account
Use another person’s account
3.2 Employer-Sponsored Access
Access to the Services may be provided through your employer. Your access may be suspended or terminated if:
Your employment ends
Your employer’s contract with SpeakEasy ends
3.3 Security
Two-Factor Authentication (2FA) may be required
You must notify us of any unauthorized access
We are not liable for losses caused by compromised credentials.
4. Listening Sessions
4.1 Parlour Sessions
SpeakEasy connects Users with Listeners for real-time conversations.
You may discuss any topic except those prohibited under Section 5 (User Conduct).
4.2 Important Disclaimer
LISTENERS ARE NOT LICENSED PROFESSIONALS.
Nothing shared during sessions should be interpreted as:
Medical advice
Mental health treatment
Legal or financial guidance
4.3 Transcription and Consent
Conversations may be transcribed in real-time
By initiating or joining a session, you consent to transcription
Transcripts may be used for:
Safety monitoring
Compliance
Quality assurance
4.4 Surveys and Feedback
Post-session surveys are optional and may be used for:
Service improvement
Usage analytics
Limited personalization
5. User Conduct
You agree to use the Services respectfully and lawfully.
5.1 Prohibited Behavior
You may not:
Harass, bully, or intimidate others
Use hateful, discriminatory, or abusive language
Engage in sexually explicit or inappropriate conduct
Attempt to manipulate or pressure Listeners
5.2 Illegal or Harmful Activity
You may not use the Services to:
Promote illegal activity
Share or solicit confidential information
Plan or coordinate harmful acts
5.3 Privacy Violations
You may not:
Attempt to obtain personal information about Listeners
Record or capture conversations without consent
Impersonate others
5.4 Platform Misuse
You may not:
Engage in spam or solicitation
Attempt to bypass safety or moderation systems
5.5 Listener Protection
Listeners may immediately terminate any session if:
Conduct standards are violated
The situation requires professional intervention
6. Respect for Listeners
Listeners are real individuals providing professional phone interaction, voice, and etc.
You agree not to:
Harass or demean Listeners
Request personal contact outside the platform
Create unsafe or uncomfortable environments
7. Safety, Monitoring, and Enforcement
To maintain safety, we may:
Monitor interactions
Review reported sessions
Take action (warnings, suspension, termination)
Notify employers when required
Contact law enforcement when necessary
7.1 Duty to Act
We may disclose information to authorities if there is:
A credible threat of harm
Imminent risk to self or others
7.2 No Guarantee of Monitoring
We do not guarantee continuous monitoring. Users remain responsible for their behavior.
8. No Professional Relationship
Use of the Services does not create:
A therapist-client relationship
A medical or legal advisory relationship
Any fiduciary duty
You are solely responsible for your decisions and actions.
9. Intellectual Property
All content, branding, and software associated with the Services are owned by The SpeakEasy Collective and protected by applicable laws.
You may not:
Copy, distribute, or reproduce content
Use branding without permission
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, including:
Merchantability
Fitness for a particular purpose
Non-infringement
11. Limitation of Liability
To the fullest extent permitted by law:
The SpeakEasy shall not be liable for:
Indirect, incidental, or consequential damages
Emotional distress or personal injury
Loss of data, revenue, or reputation
Our total liability shall not exceed the amount paid (if any) for access to the Services.
12. Indemnification
You agree to indemnify and hold harmless The SpeakEasy Collective from any claims arising from:
Your use of the Services
Your violation of these Terms
13. Termination
13.1 By You
You may stop using the Services at any time.
13.2 By Us
We may suspend or terminate access if:
You violate these Terms
You engage in harmful or prohibited conduct
Continued service would violate law
Zero-tolerance violations include:
Harassment
Hate speech
Sexual misconduct
Illegal activity
14. Dispute Resolution and Arbitration
14.1 Informal Resolution First
You agree to first attempt to resolve disputes by contacting:

14.2 Arbitration
Disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA).
14.3 Class Action Waiver
You agree to resolve disputes individually and not as part of a class action.
14.4 Time Limitation
Claims must be filed within one (1) year of occurrence.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16. Updates and Availability
We may:
Modify or discontinue Services at any time
Restrict access based on geography or employer plans
17. Miscellaneous
These Terms constitute the entire agreement
If any provision is invalid, the rest remain in effect
Failure to enforce any provision is not a waiver
